Electronic Communications Disclosure

By selecting “I agree to the eBill Terms and Conditions,” you acknowledge that you have read and understand the “Safety Insurance eBill Terms and Conditions,” and you agree to be bound by its terms and any future amendments (which may be made from time to time without prior notice) if you continue to use the service. All references to “Safety Insurance” or “we” herein include Safety Insurance Company and its insurance company subsidiaries Safety Indemnity Insurance Company, Safety Property and Casualty Insurance Company, and Safety Northeast Insurance Company. Please read the Safety Insurance eBill Terms and Conditions carefully as it contains important information about this program, including your consent to the use of electronic communications.
Types of Information to be Provided in Electronic Form. We are required to provide certain information to you “in writing.” With your consent, we can provide some of this information electronically. By enrolling in eBill, you consent to Safety Insurance providing information and billing documents in electronic form through the “My Account” section of the SafetyInsurance.com website. This may include notices, information and documents related to your policies, your insurance premium statements, and other billing-related documents and notices for all policies for which you have elected eBill (each a “Communication”). You will continue to be bound by the original payment terms and conditions stated in your insurance policy. In the event your policy account becomes past due and we issue a Notice of Cancellation because of non-payment, you will receive a paper notification via regular mail. Although you may choose to receive electronic Communications from us, state law may require that certain documents, such as Notices of Cancellation, be provided to you in paper form.
Method of Providing Electronic Communications. You must create an account and activate the policies you have selected for eBill on the “My Account” section of the SafetyInsurance.com website, which can be found at www.SafetyInsurance.com. We will send you a notice when your insurance premium statement or other Communication is available online. This notice will be sent to the email address on file under the “My Profile” page of “My Account” [or, if we offer this option and you select it, via SMS text message to the telephone number on file under the “My Profile” page of “My Account”]. It is your responsibility to access your electronic insurance premium statement or other Communication, review it, and take any required action or pay any amount you owe us on time. In the event you do not receive a notice that your premium statement is available, it is also your responsibility to log onto “My Account” and check your insurance premium statements and policy account balances. If you do not submit your payment when due, a Notice of Cancellation may be issued. Safety Insurance will not be held liable for late payments because notification was not received.
Updating Your Information. It is your responsibility to provide us with true, accurate, and complete contact information, and to maintain and promptly update any changes to this information. You can update your information, including your email address and any telephone number, through the “My Profile” page on “My Account”. Safety Insurance does not monitor undeliverable emails.
Requesting Paper Copies. You can obtain paper copies of your Communications for all policies which you have elected eBill by printing them yourself, or by requesting that we mail you a paper copy. Requests for paper copies must be made within a reasonable time after we first provide you with an electronic Communication. For assistance in accessing your Communications electronically for printing, or to request a paper copy, please contact a Safety Insurance Billing Representative at (800) 951-2100, extension 3200. There is no charge associated with requesting a paper copy of any Communication we have sent you electronically.
Communications are Deemed to be in Writing; Keeping Copies. All electronic Communications from Safety Insurance to you are deemed to be “in writing.” You should print or download for your records a copy of all electronic Communications, this “Safety Insurance eBill Terms and Conditions,” and any other document that is important to you.
Our Option to Send Paper. We always reserve the right, but are not obligated, to provide a paper copy (instead of an electronic copy) of any Communication you have authorized us to provide electronically. In addition, Safety Insurance may, in its sole discretion, elect to discontinue the eBill program. We will provide you with notice of any such termination or change, as required by law.
Return to Paper Communications. You may unenroll from eBill at any time by logging into “My Account” and following the link to “Opt-out” from eBill on the billing screen. If you are on AutoPay, you must first unenroll from AutoPay by logging into "My Account" and following the link to "Make Changes". We will not impose a fee to process your unenrollment and it will be effective only after we have had a reasonable time to process your request. Unenrolling will not affect the validity or enforceability of any Communication we sent to you before your unenrollment becomes effective. Safety Insurance reserves the right to limit or terminate your participation in eBill at any time, in our sole discretion.
Required Hardware and Software. In order to receive, access, view, and retain Communications in electronic form, you must have:
an Up-to-Date Version of Chrome, Safari or Microsoft Edge,
a connection to the Internet,
an Up-to-Date Version of an email management program,
an Up-to-Date Version of a program that accurately reads and displays files in HyperText Markup Language (“HTML”) and Portable Document Format (“PDF”) files (such as Adobe Acrobat Reader), and
a computer and an operating system capable of supporting all of the above.
By “Up-to-Date Version,” we mean a version of the software that is being supported by its publisher on the date of your transaction. Beta versions of software are not supported.
You will also need a printer if you wish to print out and retain records on paper, and electronic storage if you wish to retain records in electronic form. You must also have an active email address to receive email, and an active mobile telephone number and telephone to receive SMS text messages. In some cases, you may also need a specific brand or type of device that can support a particular software application, including an application intended for particular mobile or handheld devices.
Waiver of Liability. Safety Insurance shall have no liability for incomplete or erroneous transactions caused by the user’s provision of inaccurate information, by loss or misuse of the user’s authentication information, or for any other circumstances not subject to Safety Insurance’s control. Safety Insurance reserves the right not to process any transaction which it believes to be erroneous, unauthorized, or otherwise invalid or unlawful.
Disclaimer. Safety Insurance disclaims all warranties regarding eBill, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, or that eBill will be uninterrupted, error-free, or secure. In no event shall Safety Insurance be liable for any type of incidental, punitive, indirect, special, or consequential damages, even if advised of the possibility of such damages, whether arising under theory of contract, tort (including negligence), strict liability, or otherwise. Safety Insurance’s liability with respect to any claim shall be limited to a refund of any revenue received by Safety Insurance for processing the specific transaction giving rise to the claim.
By agreeing to these eBill Terms and Conditions, you are also confirming that you have the hardware and software described above, that you are able to receive and review electronic records, and that you have an active email account and the ability to access and view HTML and PDF files. You are also confirming that you are authorized to, and do, consent on behalf of all of your joint policyholders for any policy you enroll in eBill.
